Contest Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. Eligibility

Apperson DataLink We Love Teachers (the Contest) is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of Apperson DataLink and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to federal, state, and local laws and regulations.

2. Sponsor

The Sweepstakes is sponsored by Apperson DataLink, located at 13910 Cerritos Corporate Drive, Cerritos, California 90703-2457.

3. Agreement to Official Rules

Participation in the Sweepstakes constitutes entrants full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Contest Period

The Contest begins on May 06, 2014 at 8:00AM Pacific Time and ends on June 06, 2014 at 8AM Pacific Time (the Contest Period). Entries that are submitted before or after the Contest Period will be disqualified. Submissions will be accepted for the duration of the Contest at the Apperson DataLink Facebook page, located at https://www.facebook.com/AppersonEducation.

5. How to Enter

Visit our website (http://www.apperson.com/we-love-teachers/); review these Official Rules in full; then click through to our Facebook page (https://www.facebook.com/AppersonEducation) and upload a video two minutes or less in length to the Facebook page to tell us about a teacher that made a difference in your life. Sponsor reserves the right to allow text-based entries in addition to video entries during the contest at their sole discretion.

Limit one (1) entry per person, per email address, for the duration of the Sweepstakes Period, regardless of method of entry. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned.

6. Selection of Winners

On or about June 06, 2014, the Sponsor will select potential winners. Entries will be judged by a qualified panel of judges ("Judges") who will evaluate each Entry based on the following judging criteria:

1. Number of likes;

2. Number of shares;

3. Number of comments;

4. Overall video impact;

5. Overall video engagement.

The odds of being selected depend on the number of entries received. The Sponsor will attempt to notify the potential winner via Private Message on Facebook on or about June 09, 2014. Please check your “Other” folder in Facebook Messages, in case our message does not come to your primary inbox. If the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his/her place from the remaining non-winning, eligible entries. Unclaimed prizes may not be awarded.

7. Winner Notification

The potential winners will be notified by email, mail or phone. Each potential Grand and First Prize winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), or prize is returned as undeliverable, potential winner forfeits prize. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winners behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner per Section 6. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Sweepstakes.

8. Prizes

Grand Prize (1): $500 Visa gift card.

Second Prize (1): $200 Visa gift card.

9. General Conditions

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

10. Release and Limitations of Liability

By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, Facebook, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d)application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application the processing of entries application downloadsor in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorneys fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Entrants must be the registered subscriber of the Facebook account from which the entry is made. By entering, Entrant acknowledges that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Apperson DataLink and not to Facebook. Any questions, comments or complaints regarding the Facebook method(s) of entering Contests must be addressed to Apperson DataLink and not to Facebook.

11. Requirements of Entry

Entrants may capture the video themselves, or Entrants may have another person capture the video. If someone other than the Entrant has captured the video, the Entrant must have written permission from that person to submit the video and Entrant must be able to obtain a signed release from the videographer upon the request of Sponsor.

Entrant warrants and represents that the Video:

is original (video may be captured by someone other than the Entrant if the Entrant obtained written permission to submit the video, as set forth below);

does not infringe the intellectual property, privacy, publicity rights, ownership or any other legal or moral rights of any third party;

has not been entered in previous contests or won previous awards;

is suitable for public viewing.

By submitting an Entry, Entrant represents that he/she owns all rights to each element of his/her Entry, including, without limitation, the copyrights in the video. If someone other than the Entrant captured the video, Entrant further represents that he/she has obtained an assignment of rights from the third party that captured the video. Sponsor's determination as to whether the video violates the rights of any third party is final.

Each Entrant irrevocably grants Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), each element of the Entrant's Entry, and use of the Entrant's name, likeness, photograph (collectively, "Likeness"), and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor's use of any element of the Entry, and agrees not to sue or assert any claim against the Sponsor for the use of any element of the Entry or Entrant's Likeness or statements. Entrant further grants all end users of Sponsor's web site (a) the ability to rate, vote, review, comment on and tag the Entry; (b) the ability to send and distribute the Entry via e-mail, instant messenger, and via social media or other electronic means.

12. Disqualification

Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or Web site; to be acting in violation of the Official Rules; to be acting in violation of the terms of the Web site, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods, and disqualify any entrant using any such method. In the event of a dispute as to entries submitted by multiple users having the same account, the authorized holder of the account used to enter the Contest at the actual time of entry will be deemed to be the participant and must comply with these rules. Authorized account holder is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address.

13. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than California.

14. Privacy

Information collected from entrants is subject to sponsors privacy policy.

15. Winner List

To request the name of the winner send a self-addressed, stamped envelope to Apperson, Annt: Carrie Estrada/Marketing, 851 SW 34th Street Building B, Renton, WA 98057. Winner List requests will only be accepted after the promotion end date (listed above). Winner’s names will be posted on the Apperson DataLink Facebook Fan Page, as well.

I have been with Apperson most of my life. I think I started right out of college working in the paper warehouse, so well over thirty years. The teacher I remember the most is Mrs. Barren my Math teacher in high school. What she was able to do for me that really made me fall in love with Math was help me understand how it works. Rather than just taking something like the quadratic equation and filling it out to get an answer she took it much deeper than that. You had to understand how the quadratic equation worked. You had to be able to build the equation and that is when I really started to enjoy math. When I could dig deep into it and understand what was behind it rather than just working out equations. My name is Bill and we love teachers because they have impacted our lives in ways that open up so many doors for us.

I am the Marketing Manager at Apperson and I have been doing that for about four years now. When my son became old enough to go to school it was very hard for me to think of letting go of him. I was not ready to share him with the world. But then I met his kindergarten teacher, Mrs. Pringle, and I thought, “we're good, I have a partner who is going to help me with this and she is spectacular.”The first day of kindergarten it was really hard for me as a Mom. So we are there on the first day of school and she opens the door and she’s like “kindergarteners, are you ready?” And they are like, yeah school! This last year when my daughter was kindergarten age and I was thinking oh please let her have Mrs. Pringle. And I was so excited when we got that letter and is says your teacher is, Mrs. Pringle. Whoo hoo. To have her come home from school and say “Mom I love school. Mrs. Pringle is the best teacher!” To me as a parent that is all you can ask for. My name is Carrie, I work at Apperson and I love teachers because they are shaping our children to be tomorrow’s leaders.

In May I will have worked here twenty years. I am an account representative where I work with schools. I talk to them about our solutions and help them collect data for students and testing. My favorite part about working with teachers is being able to help them collect the data; to get more individualized instructions with the students so that they can really be able to help those kids in areas where they are struggling, so that they can be more proficient and excel. I would say probably one of the teachers that has affected my life the most was a teacher that my son had. Her name is Kathy Johnson. My son has Asperger's and was diagnosed about the age of five. She really took a special interest in my son and it went above and beyond and outside of the classroom. Kathy was one of the few people that was able to see Joshua as a human being and not just somebody as an academic student in her classroom. Somebody she could influence well beyond the classroom. My name is Corrine Foster, I work at Apperson, and I love teachers because they go above and beyond.

I have been with Apperson twenty-seven years. I am currently the National Sales director and the teacher that made all the difference to me was Melba Lloyd my English and Drama teacher. Here was this kid from the East side of town going to the same high school as doctors and lawyers kids. It was a little bit of an uncomfortable environment for me. When I walked into her English class she made it very comfortable, very engaging and really took the opportunity to get to know each of her students. She had a special interest in me, let me rephrase that, more in my name then she did me. Simply because of one of Ray Bradbury’s books. Little did I know that Douglas Spaulding was a character in one of those books and I still have that book to this day! One other hat that she wore was that she was the drama coach. She taught me that just because I was a kid from the east side of town didn’t’ mean that I was destined to be “that person”. I could be anybody I really wanted to be. Drama kind of opened my eyes to that. I could go and play and be anybody I wanted to be for a short period of time. I’m Doug Spaulding and I love teachers because they made me who I am today.

I have worked at Apperson for five years now and I do technical support for any of the education products that we offer to our customers. On a daily basis I am talking to teachers all day. I had quite a few teachers that each impacted me as the years have gone by but one teacher that kind of stuck with me all the way through was my orchestra teacher Mr. Johnson. I started playing the cello when I was in fifth grade and he was my teacher all the way up until I was a senior. He gave every student the same attention and when there was someone that was struggling it didn’t matter if it was going to hold the class up that day but that was the most important thing, to make sure that every student had the same opportunities. He really gave me a passion for music, for playing and just really sparked that in me and I still carry that with me today. My name is Gabe, I work at Apperson and I love teachers because they teach you life lessons.

I lead a team of eleven people from Charlotte to Texas to Washington. They are a client services team, we support our customers, we process orders… Supporting a team that supports teachers is like being a teacher yourself. If we are doing our jobs the right way they are teaching us while we are teaching them. When I was in high school I had a choir teacher who was the most amazing man ever. Mr. Foster, Jesse Foster was the best teacher in the whole wide world. He made me see that I had value. It didn’t matter what I looked like it mattered who I was, which gave me the opportunity to turn around and be for other people what he was for me.
